President Trump on Monday announced that he was removing Lisa Cook from the Federal Reserve Board of Governors due to allegations of mortgage fraud. (WSJ.) Cook responded that the President had no authority to remove her and she would not resign. (Politico.)
Judge Lance E. Walker (D. Me.) on Monday denied plaintiffs’ motion for a preliminary injunction which would have blocked enforcement of legislation prohibiting major abortion providers from receiving Medicaid funding. (Order.) (NYT.)
Judge Amir H. Ali (D.D.C.) on Monday denied defendants’ motion for a partial stay of a preliminary injunction which requires the Trump administration to obligate congressionally appropriated foreign aid funds. (Order.)

Judge Royce C. Lamberth (D.D.C.) on Monday ordered Kari Lake and two other defendants to sit for depositions about whether they are complying with the court’s preliminary injunction ordering them to operate Voice of America in fulfillment of its statutory mandate. President Trump on Monday issued several executive orders. One directed the attorney general to prosecute the burning of the American flag. (Executive Order.) William Baude raised two constitutional questions with the interstate deployment of National Guard forces: (1) “whether such deployments violate Article IV of the Constitution,” and (2) “whether federal support for those deployments are within the Article I militia power.” (Divided Argument.)
Pending Interim Order Applications Involving the U.S. Government in the Supreme Court
Noem v. Perdomo: The government filed an application on August 7 to stay a federal district court order preventing federal immigration officials in Los Angeles and six other California counties from conducting detentive stops based on the following factors, according to the application: “[1] apparent race or ethnicity; [2] speaking in Spanish or accented English; [3] presence at a location where illegal aliens are known to gather; and [4] working or appearing to work in a particular type of job.” Pedro Vasquez Perdomo filed a response in opposition to the government’s application for a stay on August 12. The government filed a reply in support of its application for a stay on August 13.
